1- Parties: The "Tenant" refers to any person who books the furnished holiday accommodation Le Moulin des Etrebières ("the Accommodation"). The "Owner" refers to SCI les Etrebières, the owner and manager of the Accommodation.
2- Purpose : The purpose of these general rental conditions is to govern the reservation of a stay in the Accommodation on the internet, by telephone, by mail or in person.
3- Capacity : The number of people using the rental cannot exceed the maximum accommodation capacity indicated in the description (i.e. 15 PAX IN THE MAIN HOUSE AND 4 PAX IN THE ANNEX). Babies sleeping in travel cots count as one person. The Owner will not be able to admit additional occupants, even temporarily. The installation of tents or the parking of caravans on the Accommodation grounds is prohibited and will result in the immediate termination of the contract at the Tenant's expense.
4- Confirmation: After booking the Accommodation, the Tenant will receive a confirmation by email summarising the main characteristics of the reservation. The reservation becomes final upon payment of a deposit of 25% of the price of the stay. If the time between the reservation date and the start date of the stay is 30 days or less, the amount for the entire stay must be paid upon reservation.
5- Balance : The balance of the price of the stay is due 30 days before the start of the stay. If the Tenant has not paid the balance on the date indicated, the stay is considered cancelled and the Accommodation can be offered for rental again. The deposit will not be refunded.
6- Duration of stay: The reservation is concluded for a specific period indicated on the contract. The Tenant may under no circumstances claim any right to remain in the premises at the end of the stay.
7- Non-transferability: Subletting is strictly prohibited, even free of charge, and will result in the immediate termination of the contract at the Tenant's expense.
8- Pets : Pets may be admitted to the accommodation when the following conditions are met.
- The Tenant must obtain the explicit agreement of the Owner, specifying the number and type of pets;
- additional charges (70 euros per pet per stay) and an additional security deposit (200 euros per pet) will apply;
- compliance with the following rules:
• Pets will only be allowed in the laundry room and living room of the main house, but under no circumstances in the bedrooms, bathrooms and stairs ;
• pets will stay on the ground and will not be allowed to climb on furniture, sofas, etc. ;
• under no circumstances may sheets, duvets, cushions and other equipment meant for Tenants be used for pets ;
• pets will not remain alone in the Accommodation. If the Tenant has to be away for a short period of time, pets may remain in the laundry room ;
• pet faeces will be collected and disposed off properly by the Tenant, wherever they may be on the property.
Reminder : the law of July 9, 1970 makes the presence of pets conditional to their not causing any damage to the Accommodation.
9- Cancellation : * cancellation by the Tenant : The cancellation fees applied are as follows:
The following cancellation charges apply:
- cancellation 2 months before the start of the stay: the deposit will be retained by the Owner;
- cancellation 1 month or less before the start of the stay: no refund will be made;
- if the Tenant does not show up before 9 p.m. on the scheduled start day of the stay, this contract becomes void, no refund will be made and the Owner will have full use the Accommodation;
- shortened stay: no refund will be made.
* cancellation by the Owner : Any cancellation by the Owner before the start of the stay is notified to the Tenant by registered mail. The Tenant is immediately reimbursed for the sums paid. These provisions do not apply when an agreement is made between the Parties with the acceptance by the Tenant of a substitute stay offered by the Owner.
10- Security deposit : The Tenant pays a security deposit of 2,000 euros upon arrival. It will be returned within a maximum period of one month from the Tenant's departure, after deduction by the Owner of the amounts payable by the Tenant for the purposes of restoration of the premises and/or various repairs. The amount of these deductions must be duly justified by the Owner. If the security deposit proves insufficient, the Tenant undertakes to supplement the amount on the basis of the supporting documents provided by the Owner. The security deposit cannot under any circumstances be considered as a contribution to the price of the stay.
11- Arrival : the rental begins at 5 p.m., unless previously agreed. The Tenant must arrive on the specified day and at the times mentioned in the reservation contract. In the event of late or delayed arrival, the Tenant must notify the Owner. On arrival, the Owner welcomes the Tenant, shows them around the Accommodation and explains how the equipment works. The Owner hands over the Accommodation keys to the Tenant after signing the inventory.
12- Inventory: an inventory of the premises and equipment made available to the Tenant, as well as their state of cleanliness, is established jointly and signed by the Tenant and the Owner upon arrival at the Accommodation. It constitutes the only reference in the event of a dispute concerning the inventory of fixtures. Cleaning of the premises is the responsibility of the Tenant during the rental period and before departure. In the event of an early departure preventing the establishment of the inventory on the day of the Tenant's departure, the inventory is done by the Owner alone and the security deposit is returned within one month with deduction of the amounts payable by the Tenant if necessary.
13- Use of the premises : during the duration of the stay, the Tenant enjoys the use of the Accommodation in a peaceful manner and makes good use of it. The Tenant undertakes to maintain the sanitary, electrical and heating installations in good condition. All installations are deemed to be in perfect working order, the Tenant will have 24 hours to notify the Owner of any anomalies observed. After this period, the rented goods will be considered free of damage upon entry by the Tenant. Any repairs made necessary by negligence or misuse during the stay will be the responsibility of the Tenant, both in the Accommodation and on the entire property.
14- Supplies : Beds are made upon arrival. Kitchen and bathroom towels, hygiene products (soap, shower gel) and household cleaning products are provided. Cleaning of the premises is the responsibility of the Tenant during the rental period.
15- Departure : the rental ends at 10 a.m. and the Tenant returns the keys to the Owner. For the exit inventory, the Tenant must return the Accommodation in good condition, as they found it (furniture and equipment in their original place) and in a reasonable state of cleanliness (refrigerator emptied, dishes put away, trash cans emptied, sorted and placed in the exterior container, oven and barbecue cleaned, floors and sanitary facilities clean). In the event of excessive dirt, the additional cleaning hours necessary to restore the Accommodation to its original state will be deducted from the security deposit.
16- Charges: Water, gas and electricity charges (except charges linked to the electric vehicle charging station) are included in the price of the stay, within the limit of normal use. At the end of the stay, the Tenant will pay to the Owner the charges not included in the price of the stay.
17- Tourist tax : The tourist tax is a local tax payable by the Tenant together with the balance of the reservation. The Owner then transfers the amount to the local council.
18- Responsibility of the Owner: The Owner cannot be held responsible for fortuitous events, cases of force majeure or due to any person unrelated to the organisation and progress of the stay.
19- Internet user charter : Browsing is done under the sole responsibility of the user. It is prohibited to consult Internet sites and pages with prohibited content such as pornography, pedophilia, racism, incitement to violence. Likewise, copying copyrighted works is prohibited. All Internet activity is recorded and can be checked if abuse is suspected.
20- Legislation : Where possible, complaints will be settled amicably. Failing that, the parties agree that these general rental conditions are governed by French law.
21- Insurance : The Tenant is responsible for all damage occurring to the Accommodation as a result of their misuse. The Tenant must have a holiday/travel insurance contract to cover these risks. An insurance certificate may be requested upon entry to the premises or, failing that, a sworn statement.
22- Protection of personal data : The Client is informed that the personal data communicated for the establishment of the contract may be processed to manage the reservation, respond to the Tenant's questions and requests, improve the services and personalise the Tenant's experience, send information relating to the reservation or Accommodation, inform the Tenant about special offers, promotions or upcoming events, if the Tenant has consented to receive such communications.
In accordance with Regulation (EU) No. 2016/679, known as GDPR, each Customer has the right to access, rectify, oppose, delete and limit the processing of information concerning them. These various rights can be exercised by contacting the owner at gaelle@moulindesetrebieres.com
By requesting a reservation, the signatory acknowledges having read the general rental conditions and accepting their terms, and is responsible for ensuring that these conditions are respected by the other people taking part in the holiday.
